Compulsory MTPL Insurance

• Cases where the insured is not at fault for the accident;
• Cases where the accident was caused solely by the fault of the injured party;
• Damages to property belonging to the driver of the at-fault vehicle, as well as bodily injury or death of that driver;
• Damages to the personal property of the at-fault person;
• Cases where the damaged property is part of the spouses' joint estate;
• Reduction in the value of property after repair;
• Damages to transported goods, if a transport contract existed between the owner, user and/or driver of the at-fault vehicle and the injured persons at the time of the accident;
• Other exclusions provided by law.

• The portion of the loss exceeding the liability limits;
• Damages caused by military measures imposed during a state of emergency, siege or war, or by actions caused by natural disasters, nuclear explosions, radiation or radioactive contamination, mass civil unrest, or terrorist activities;
• Damages resulting in environmental pollution caused by an accident;
• Lost profit or income.

Compulsory domestic RCA insurance provides coverage only within the territory of the Republic of Moldova.

• To pay the insurance premium;
• To take all possible actions to mitigate the damages caused;
• To notify the RCA insurer that issued the compulsory RCA policy about: the occurrence of the accident, within 48 hours of its occurrence; the persons involved in the accident and the injured party about the fact that I hold a compulsory RCA policy and to provide the necessary information about the RCA insurer;
• To notify the insurer upon conclusion of the contract, regarding the purpose of vehicle use and legal status, including whether the vehicle will be used as a taxi;
• To provide, at the request of the RCA insurer, access to the vehicle that caused the accident;
• To inform the RCA insurer about the disposal of the vehicle.

Payment of the insurance premium is made in full before the issuance of the insurance policy.

Compulsory RCA insurance is concluded for a period of 12 months, unless the insurance contract provides otherwise.

The insurer's liability begins:

• From the day following the expiration of the previous compulsory RCA insurance contract, for an insured who fulfills the obligation to conclude insurance no later than the last day of validity of that contract;
• From the day following the conclusion of the compulsory RCA insurance contract, for persons who did not have a valid compulsory RCA insurance at the time of concluding the new insurance;
• From the moment indicated in the compulsory RCA insurance contract, but no earlier than the date of entry into force of the provisional registration certificate or vehicle registration certificate, for vehicles being sold that are to be registered;
• From the moment indicated in the compulsory RCA insurance contract, for persons using a vehicle registered abroad on the territory of the Republic of Moldova;

The insurer's liability ends at 24:00 on the last day of validity of the compulsory RCA insurance contract, or before that day, at the time the vehicle is deregistered by the competent authorities.

The compulsory domestic RCA insurance contract may be terminated by a notification addressed in advance to the insurer, on the following grounds:

• Withdrawal of the insurer's license;
• Notification by the insured regarding the transfer of vehicle ownership, accompanied by supporting documents;
• Agreement of the parties;
• Other cases provided by law.

Upon disposal of the vehicle, the insured is obliged to inform the insurer. In this case, the insured has the option to assign the rights under the compulsory domestic RCA insurance contract to the new owner or to terminate the existing contract. The return of the insurance premium, under the conditions of art. 10 para. (7) of Law no. 106/2022, may only occur if no insurance indemnities have been paid or are owed for damages caused during the validity period of the compulsory domestic RCA insurance contract. In the case of assignment, the insurer will adjust the insurance premium based on the respective risk factor of the new owner.
